Terms and Conditions – Muslim Travel SA

1) Intellectual Property Rights
All the content on this site, including text, graphics, logos, icons, designs, colours, layout and trademarks are the intellectual property of Muslim Travel SA and its associates and are as such protected by South African and International Intellectual Property Law.

2) Undertaking
Muslim Travel SA undertakes to provide all services offered subject to the terms and conditions set out herein, which terms and conditions are accepted by the passenger.


  1. a) Muslim Travel SA means the company registered in South Africa as “Muslim Travel SA (2018/612324/07)”
    b) Traveller/passenger/client means: Individuals, groups, companies or other legal persons using the services offered by Muslim Travel SA and includes the agents of travellers.
    c) Services means: The provision of accommodations and/or transportation and/or meals and/or any and all other travel services and activities as offered or provided by Muslim Travel SA and accepted by the traveller.

4) Agreement and Alterations
The information contained on this site is an invitation to do business and not an offer. If you forward an offer to us, Muslim Travel SA shall indicate their acceptance thereof by return email. Muslim Travel SA acts herein as an agent for our respective business partners and therefore any agreement resulting from the acceptance of an offer is deemed to be an agreement between the relevant business partner and yourself.
Muslim Travel SA reserves the right to make changes to this site and this user agreement at any time without notice.
All tours, itineraries, travel arrangements, hotel accommodation and other arrangements are subject to alterations or cancellations at any time without prior notice and for any reason, at the sole and absolute discretion of Muslim Travel SA. Muslim Travel SA shall not be responsible for any damages whatsoever arising from any such alteration or cancellation.

5) Booking and Payment
In order to confirm our clients’ reservation, Muslim Travel SA requires a 30% deposit payment at the time of making your booking. The balance of payment is due 8 weeks (60 days) prior to the commencement date of your itinerary. Bookings made within 8 weeks (60 days) prior to departure are subject to full prepayment at the time of confirming the reservation. If the required deposit or final payment is not received by the due date, Muslim Travel SA reserves the right to withdraw services.
The non-issuing of an invoice or non-payment of deposit will not exempt travellers from these payment terms. Payments may be deposited directly into the following bank account:

Clients are preferred to settle payment by means of a bank transfer – in this instance the amount will be converted by your bankers on presentation of our invoice. It is the client’s responsibility to inform and instruct their bankers that the net invoice amount must equal the funds clearing into the Muslim Travel SA bank account and that ALL bank charges are for the client’s account.
Please note that should you wish to settle payment by means of a credit card, payment will be made in South African Rands (ZAR) due to foreign exchange regulations by the South African Reserve Bank. The rate of exchange on the day that the transaction is processed will be used to determine the equivalent Rand amount with any resulting foreign exchange differences or bank charges being for the client’s account. The exchange rate applied by the official bankers of Muslim Travel SA on receipt of moneys will be accepted as the applicable rate.
For tours that include services of certain suppliers with more stringent policies, e.g. National Parks Board, Blue Train, Rovos Rail, Private Lodges and others, different payment terms may be enforceable. These will be provided when applicable.
Large group programs may attract specific payment terms which will be provided when applicable.
Prices are also subject to adjustment in the event of changes in government imposed taxes, fuel price, hotel charges, tourism levies and or the introduction of national, regional or local taxes or levies of whatever nature. All prices and rates are quoted in ZA Rand, unless otherwise specified

6) Flights and Payment
All airfare reservations and cancellations are arranged subject to the conditions imposed by the respective airline.
Please note that in the event of flights being booked and secured by Muslim Travel SA on behalf of the client, payment is required at the time of booking and by credit card because of the time delay of securing funds to us when paying by bank transfer. In addition to this, when booking flights with Muslim Travel SA, we require a copy of all passengers’ passports. Airlines require the full names of passengers as printed on the passports and will not accept changes once tickets are issued. It is a security procedure which will ensure there are no discrepancies. Muslim Travel SA accepts no responsibility for incorrect passport numbers or incorrect spelling of full names. Please ensure that you provide accurate information to your Muslim Travel SA Consultant. ‘No shows’ will be charged 100% of the quoted tour price. We recommend that travellers take adequate personal cancellation insurance cover before departure from home.

7) Cancellations and Refunds
All cancellations and refund requests shall only be valid if received by Muslim Travel SA in writing. For any reservation cancelled within 30 days of the arrival date, a charge to the full value of the service booked will be made and any refund is subject to the discretion of the management. These cancellation fees are also subject to the discretion of Muslim Travel SA.
Amendments and all cancellations en route must be made with Muslim Travel SA directly. Please note that en route cancellations and amendments may incur additional fees as determined by Muslim Travel SA. Any such amounts due as a result of such amendments or cancellations are payable directly to Muslim Travel SA.
No refunds will be made for no-shows, or any unused services irrespective of whether they form part of the basic tour price, or whether they are in respect of pre-booked optional arrangements.
Cancellations made more than 60 days prior to arrival will not normally result in cancellation fees being charged. However Muslim Travel SA reserves the right to recover any costs incurred or charges received from suppliers up to the date of cancellation.
In the event of services being cancelled 60 days or less, prior to arrival, the following cancellation fees will apply:
Cancellation prior to 8 weeks of travel – Full 30 % of the total quoted price due is forfeited by the passenger plus any additional charges levied by suppliers up to date of cancellation.

Cancellation 8 – 4 weeks prior to travel – 50% of the total quoted price due is forfeited by the passenger plus any additional charges levied by suppliers up to date of cancellation.

Cancellation less than 4 weeks prior to travel – 100% of the total quoted price due is forfeited by the passenger plus any additional charges levied by suppliers up to date of cancellation.
For tours that include services of certain suppliers with more stringent policies, e.g. National Parks Board, Blue Train, Rovos Rail, Private Lodges and others, different cancellation fees will be enforceable. These will be provided when applicable.
The non-issuing of an invoice or non-payment of deposit will not exempt travellers from these cancellation terms.
No refund or credit will be granted for travellers that:
Fail to join a tour, OR
Join the tour after the departure date, OR
Leave the tour prior to the completion date, OR
Fail to arrive at the accommodation establishment(s), OR
Arrive at the accommodation establishment one day or more later, OR
Leave the accommodation establishment one or more days early

8) Child Policy
Children of all ages are welcome on our tours, provided they are accompanied by a parent, guardian, minder, or teacher. Bookings on our escorted overland tours are strictly subject to the availability of child- friendly accommodation at the time of request. Children discounts, where applicable, may vary depending on the tour. Please contact us for rates specific to the tour and ages of the children. Parents travelling with children, without the other parent, will need a letter of consent from the absent parent. The letter of consent must be certified by the police.

9) Passports
Please note that anyone travelling to Southern Africa must have two consecutive blank pages in their passport which lie side by side when the passport is open (i.e. a left and a right hand page). For some countries, passengers are required to have more than two blank pages. Please ensure that this is confirmed by the South African Embassy in your home country prior to departure. Passengers travelling to Southern Africa with passports which do not comply with these requirements, will either be stopped from boarding the aircraft or risk deportation on arrival in Southern Africa. Please ensure that you possess all the required documentation as per South African Immigration regulations. Ensuring that passports comply with immigration requirements is the sole responsibility of the client.

10) Tour Price Exclusions
The tour price excludes: Any tips and gratuities (left to the individual’s discretion); personal items (beverages, cigarettes, telephone calls, room service, laundry and other extras); meals Unless specified as part of a package) air and rail fares (unless specified as part of a package); visas, health requirements, activities not included in the itinerary and immigration requirements. (Muslim Travel SA accepts no responsibility if such documentation is not in order – visitors should consult their travel agents.)

Much care has gone into the composition of programs and tours for travellers, however circumstances such as currency devaluation, fuel surcharges or price amendments by suppliers may necessitate changes in costs and tour programs. Should this occur you would be notified as soon as possible, although Muslim Travel SA does reserve the right to change the itinerary of the tour without prior notice. Notwithstanding that deposits or complete payments have been made, any increases up until the date of departure of arrangements resulting to the above are to be paid by the traveller. If such increases are unacceptable, the traveller may cancel his/her booking, though in so doing he/she is still liable to pay any cancellation charges imposed in the way of cancellation, administration, communication charges etc.

12) Accommodation
Accommodation is as specified in the itinerary or brochure and is based on 2 people sharing a twin bedded room (2 x single beds or a double bed). The use of specific accommodation is subject to availability. Muslim Travel SA reserves the right to substitute hotels with other of a similar or higher category at no additional cost to the traveller, even after commencement of the tour. Single accommodation is available at an extra cost on a first come first served basis.

13) Meals
Meals included are as specified in the tour itinerary. Please check the applicable itinerary for details.

14) Transportation
Sub contracted transportation is in air-conditioned luxury SUV’s, Minivans, Quantums, Coaches or Sprinters appropriate to the requirements of the tour and based on passenger numbers. Vehicles provided are large enough to accommodate the number of passengers and luggage. All drivers are licensed in terms of local legislation. All vehicles are safe and comply with relevant safety regulations

15) Health & Visas
It is the responsibility of the agent and/passengers to ensure that all the necessary documentation and/or precautionary medication measurements are attended to prior to travel. Muslim Travel SA does not accept responsibility in this regard.
Travellers undertake that they have made themselves aware of and accept the potential hazards related to travel, including injury, disease, loss or damage to property, inconvenience and discomfort and satisfied themselves prior to booking that they are fit and able to complete the itinerary of the chosen tour.
If the Traveller has any pre-existing medical condition or illness, they must declare the true nature of such condition at the time of booking and make arrangements for the provision of any drugs or other cause of treatment which may be required during their trip.

15) Luggage
It is the responsibility of the traveller to ensure that all luggage is clearly marked. One standard set of luggage, comprising one suitcase and one overnight bag per person is recommended.

16) Right of Admission Reserved
Muslim Travel SA shall at its discretion enforce conduct rules, and reserves the right to decline to accept or retain any person as a passenger. Passengers shall obey every lawful instruction of any employee of Muslim Travel SA. Passengers may not carry any firearms, articles or substances whilst travelling with Muslim Travel SA, whether on a tour or transfer. Muslim Travel SA reserves the right to decline to accept or retain any traveller as a member of any group, conference, or on any tour or transfer at any time as the result of the non-payment of any amount due by the traveller or if such traveller is deemed by the Tour Manager/Tour Guide to interfere with and/or cause disturbance to any other member of any group. Any financial losses incurred to the traveller as a result of this will be the sole responsibility of the traveller.

17) Smoking
Smoking is not permitted on board our Muslim Travel SA vehicles. Comfort stops will be made en route. Smoking is also not permitted in closed public places and offenders are liable to fine and/or imprisonment.

18) Check In Time
Passengers shall check in at all departure points at least 30 minutes before the scheduled departure time. Muslim Travel SA does not accept responsibility for any passenger who fails to comply with this condition.

19) Delays
Muslim Travel SA shall not be responsible for the consequences of any delays whether arising from accidents, breakdowns, or any other cause.

20) Force Majeure
Muslim Travel SA is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

21) Responsibility
Muslim Travel SA does not have direct control over the provision of services by hotels, airlines and suppliers and shall not be liable for any loss, damage, injury, additional cost, accident, delay or irregularity that may be occasioned by any error or default.

22) Insurance
All travellers are advised to and are solely responsible to take out comprehensive travel insurance including full medical cover as well as cancellation and curtailment cover and to familiarise themselves with any exceptions and conditions as may be imposed by the insurance company or underwriters issuing the policy of insurance which they select. Muslim Travel SA holds the relevant public liability insurance as required by South African Law

23) Editorial Control
This website contains content provided by third parties and hyperlinks to other sites. Muslim Travel SA does not screen or filter such content or the other sites or information available from the other sites, and therefore does not accept any liability for defamatory, illegal or criminal content contained on those sites. We encourage our users to report any infringement, illegal or criminal content found on any of the sites available through links from this site in order to investigate whether such a link should be removed. Due to the variation of season our rates are purely an indication and whilst we do our level best to maintain the accuracy these are indicative.

24) Privacy and Subscription
Muslim Travel SA will keep all personal information you give us as strictly confidential and no personal information will be made available or sold to third parties, unless obliged to do so by law or legal process. This site may use “cookies” to customise it and make your visit to us more user friendly. Cookies cannot harm your computer in any way and are an industry standard. They are small text files that contain only information provided by you, the visitor, to the website. Furthermore, our users may configure their browsers to not accept our cookies. Muslim Travel SA may send e-mail messages to our customers with news and special offers and users may, by return mail, indicate whether they would prefer not to receive any such mail in future.

25) Law/Jurisdiction
This site is created, maintained and controlled in South Africa and as such, the laws South Africa shall govern the relationship between Muslim Travel SA and the passenger and the Courts South Africa shall have sole jurisdiction in respect of any claims and/or disputes which may arise between Muslim Travel SA and the passenger, or Agent.

26) Complaints
All complaints must be lodged in writing to [email protected] no later than 14 days after your trip. Muslim Travel SA reserves the right to investigate complaints before arriving at a decision.

27) Disclaimer
Although Muslim Travel SA endeavours to provide accurate, up-to-date and truthful information on this site, neither Muslim Travel SA nor any of its employees, agents and associates make any representations or give any warranties, whether expressly, tacitly or implied, as to the operation of the site, the information, content, materials and products included and available from this site.

Muslim Travel SA, its employees, agents and associates will not be liable for any damage of whatsoever nature arising or resulting from the use of or inability to use this site or the information contained hereon, including but not limited to direct, indirect, incidental, punitive and consequential damage.

Muslim Travel SA, its affiliated subsidiary companies, agents, and sponsoring organizations act only as agent for the suppliers of transportation, accommodations, food, and other goods and services provided to the passenger. All arrangements for transport, accommodations, and services are made upon the express condition that Muslim Travel SA shall not be liable for any direct, indirect, consequential, or incidental damage, injury, loss, accident, delay, or irregularity of any kind occasioned by reason of any act or omission beyond its control, including, without limitation, any act of negligence or breach of contract of any third party such as an airline, cruise line, train, hotel, restaurant, ground handler, etc., who is to or does supply any goods or services for the tour. Without limiting the foregoing, Muslim Travel SA is not responsible for any losses or expenses due to delay or changes in schedule, overbooking of accommodations, default of any third parties, sickness, weather, strikes, acts of God, acts of terrorism, war, quarantine, criminal activity, or for any other cause beyond its control.
Safari programs may take travellers into close contact with wild animals. Rangers and guides should brief travellers accordingly, however, neither Muslim Travel SA nor their employees can be held responsible for any injury or accident while on safari.

Muslim Travel SA, their employees, agents and associates shall not be responsible for and shall be exempt from any liability in respect of any loss, damage, injury, accident, delay or inconvenience to any person or their luggage or other personal property whether the same shall occur and whether the same shall arise from or be occasioned by the negligence of Muslim Travel SA, their employees, agents, associates and other persons indirectly in the employ or service of Muslim Travel SA or otherwise under any circumstances whatsoever.

Muslim Travel SA is indemnified and held harmless against any and all claims, losses, damages and/or costs, howsoever caused, arising directly or indirectly from these Terms and Conditions and any tours operated or organised by Muslim Travel SA. Nothing in this Agreement shall operate so as to exclude or in any way limit the Travellers´ or Muslim Travel SA’s liability for fraud, or for death or personal injury caused by either´s negligence or any other liability that may not be excluded or limited as a matter of law.
